The sharp drop of $ATAIMS might be due to another alleged forced labor conditions by Andy Hall. Not sure bout $SKPRES.

Andy Hall was also the same harsh critic that was previously involved in $TOPGLOV's CBP ban.

Andy Hall claims that there are "alleged forced labor conditions including, but not limited to, unethical recruitment practices and inadequate working/living conditions." This had brought the company to tank mid noon. EMS peers in Johor $VS / 6963 (V.S. INDUSTRY BERHAD) and $SKPRES / 7155 (SKP RESOURCES BHD) also took a beating with each company closing the day at -6.5% and -13.5% respectively.

KUALA LUMPUR (May 21): Electronics manufacturing services (EMS) provider ATA IMS Bhd was bogged down by heavy selling on Thursday. Its share price tumbled nearly 18% or 51 sen to close at RM2.33 — the lowest since Feb 3 when it traded at RM2.27.

This resulted in some RM614 million market capitalisation being wiped off from ATA IMS in a single day. Trading volume swelled to 11.93 million shares, over three times its 200-day average trading volume of 3.76 million shares.

Some quarters attributed the heavy selldown to the US Customs and Border Protection's (CBP) decision to initiate an investigation into the company, which has been accused of using forced labour.

Migrant worker rights specialist Andy Hall has filed a petition to the CBP to investigate ATA IMS, and provided what he claimed was information on alleged forced labour conditions, including but not limited to, unethical recruitment practices and inadequate working/living conditions at ATA Industrial (M) Sdn Bhd — a unit of ATA IMS in Johor.

When contacted, Hall shared the reply letter he received from the CBP. The letter noted that the US authorities would open an investigation to review if there was any forced labour involved in ATA Industrial's activities.

"CBP reviewed the petition and determined the information is sufficient to investigate the merits of this allegation.

"The length of time needed to review an allegation depends on a variety of factors, some of which are beyond CBP's control. If CBP finds the information meets the threshold, CBP will issue a Withhold Release Order," said CBP in the letter dated April 19.

Nonetheless, ATA IMS' executive chairman Datuk Seri James Foo told The Edge that the company has not received any communication from CBP regarding the issue.

He also refuted claims that the company is using forced labour in its manufacturing process.

"None of our employees are subject to forced labour. As a contract manufacturer, we are bound to apply the international labour standards adopted by our main customer. We are audited by our main customer and the global retailers of our main customers' products regularly to ensure strict compliance," said ATA IMS when contacted by The Edge.

"Our recruitment practice is fully compliant with international best practices. In particular, we pay for all recruitment costs so that our workers do not pay any recruitment fees on their part. Also, our workers keep their own passports," it added.

The company believes that it provides good living conditions for its workers. "We believe our dormitories are the best in class with a gym, safe deposit boxes, Wi-Fi, cafeteria and other amenities within our compound," it said.

On Bursa Malaysia, the selling spilled over to ATA IMS peers — SKP Resources Bhd and VS Industry Bhd — both of whose share prices also headed south.

SKP Resources slid 13.42% or 20 sen to settle at an eight-month-low RM1.29, valuing it at RM2.02 billion. VS Industry dropped 6.5% or eight sen to close at RM1.15, giving it a market value of RM4.34 billion. The stock was also nearly at its eight-month low from when it was trading at RM1.14 on Sept 29, 2020.

The trading volume for both SKP Resources and VS Industry stood at 9.83 million and 25.73 million shares respectively, both exceeding their respective 200-day average trading volumes of 5.35 million and 14.75 million shares.

Andrew Jonathan Hall (born 30 October 1979 in Spalding, Lincolnshire, England) is a migrant worker and labour rights activist and researcher, formerly based in South East Asia.

In early 2013 Hall was sued by Natural Fruit Company following the publication of the Finnwatch report "Cheap Has a High Price".[1] Hall claimed to have interviewed workers for the report, some of whom were undocumented migrants and reported poor working conditions, unlawfully low wages, confiscation of official documents, use of child labour and excessive overtime. Altogether Natural Fruit has brought four cases against Hall, for alleged defamation and computer crimes. Many international human rights organisations and trade unions, as well as UN agencies and the European Parliament and European Trade Commissioner, have condemned Natural Fruit's actions as judicial harassment and an attempt to silence a human rights defender, and called for the cases to be dropped.[2]

At Hall's July 2016 trial, Finnwatch testified that the report alleging human rights abuses by Natural Fruit Co was analysed, written, and published by NGO Finnwatch, not by Hall, who was hired merely as a local investigator.[3] However, Hall is identified in the report as the leader of the Finnwatch investigation in Thailand.

Of the four lawsuits against Mr Hall,[4] for which he could face up to 7 years in prison, the two criminal cases have been ruled in his favour already. On 05 November 2016, the Supreme Court ruled in favour of Mr Hall on the charge of criminal defamation (Aljazeera interview case) dismissing the case for a third and final time. On 31st May 2018, the Appeals Court rules in favour of Mr Hall on the charge of criminal defamation and computer crimes (Finnwatch report case). The two remaining cases are both civil defamation claims, one of which has been ruled in favour of Natural Fruit. [3]

On 20 September 2016 Hall was at a court of first instance (Bangkok South Criminal Court) found guilty of criminal defamation and violation of Thailand's Computer Crimes Act. The court sentenced Hall to prison for four years and ordered him to pay a 150,000 baht fine. His prison sentence was reduced to three years and suspended for two years because of his record as a human rights defender. Hall appealed the ruling.[5] The president of Natural Fruit, Wirat Piyapornpaiboon, commented on the ruling outside the Court house to international media, saying, "No foreigner should think they have power above Thai sovereignty,..."[6]

On 26 March 2018, the Prakanong Court in Bangkok issued its verdict on the civil damages claim against Hall, ordering him to pay 10 million baht (US$320,000) in damages to the company. The court also ordered Hall to pay 10,000 baht to the plaintiff's lawyer and court fees including interest of 7.5 percent from the date of filing this case until the amount is fully paid. Hall will appeal the decision, particularly given the Supreme Court had already in 2016 dismissed the accompanying criminal case.[7][8]

The Thai Court of Appeals more recently on 31st May 2018 acquitted Hall of criminal defamation and computer crimes, overturning a lower court ruling. The Appeals Court ruled that Hall had not acted unlawfully as charged by the prosecution. The court further ruled that, based on the evidence before it, Hall had indeed interviewed migrant workers from Natural Fruit's factory and there were labour rights violations against migrant workers at Natural Fruit, and that the research was in the public interest.[9] Natural Fruit can appeal the Appeals Court ruling to the Thai Supreme Court.[10]

We have also successfully gained SEDEX membership and OHSAS 18000 certification
which ensures that our social compliance and occupational health and safety practices are in
adherence with internationally recognized standards.
In relation to foreign workers recruitment, the Group fully adopts international best practices,
a key aspect of which is a zero-recruitment cost policy, such that the Group’s foreign
workers are not required to pay recruitment and/or agent fees to any third parties during the
recruitment process. The recruitment agents that the Group engages are also required to
undergo a due diligence evaluation process to ensure their compliance with such practices.
All employees are offered fair and no less than the minimum wages as stipulated by the
Malaysian labour laws, including for overtime work which are on voluntary basis.
Compulsory rest days are also adhered to so that employees have sufficient rest and
recreation for their overall health and well-being. Training and workshops are also given to
employees at regular intervals, and those who have displayed high performance and good
discipline have been afforded career advancement opportunities.
The Group provides hostel accommodation for all foreign workers which meet international
labour standards adopted and audited regularly by our main multinational customers and
global retailers. These accommodations surpass the Malaysian government’s guidelines for
minimum standards for foreign workers’ accommodation (Guidelines for Minimum Standards
for Foreign Workers’ Accommodation 2018), and are complete with well-equipped cafeterias
or kitchens, gyms, wifi access, recreation facilities and sick bays.
The foreign workers also have unrestricted access to individual lockers for safekeeping of
their passports and personal documents, and assistance from human resource personnel or
representatives to discuss grievances and/or provide suggestions related to work or hostel
The group has not received any communication from the US Customs and Border Protection
(CBP), or any other similar government authority on any matter as of today, and that the
Group does not practice any form of forced labour in its operations as alleged. In any case,
the Group will address any inquiries from and will be prepared to cooperate with CBP or
other government authorities promptly if any such communication is received.

Finally, people are waking up. I don't hold any ATAIMS but I am sorry for it's shareholders.

Once they get TG to obey, they will think their strategy works in Malaysia and will continue to use the same strategy. US is obviously a hypocrite. What human rights problem? They created the evidence themselves. All they care about is their own interest.

I once thought Palestinian are the problem but I was wrong. It is very clear now, the aggressor is the Israelis, with many evidences. It is sad how the veto power ally America is shielding them from their crimes. But we're not surprised looking at those shit they are trying to spur up on matter like Israel-Palestinian, Xinjiang, TG, Black Lives Matter, Asian Hate Crime etc.

The American Empire is constantly in decline. It's end will be just like the Romans and the British, etc. It will come a time it's CAPITALIST system will swallow itself. Marxism, one of the economics school of thought, that you can barely find in the US, is one of the most important critique to capitalism.

Capitalism is about the exploitation of labour, the maximization of profits, and reducing the cost of labour. Capitalism had build within it the seed of destruction. It will come a day where capitalism will exhaust it's potential and collapse. Capitalism expansion is not eternally sustainable and when it is unable to expand and unable to generate profits at past level, the capitalist system will consume the structure that sustain it. It will prey upon in the name of austerity, the working class and the poor, driving them ever deeper into debt and poverty and diminishing the capacity of a state to serve the basic need of ordinary citizen. It would as it has increasingly automate or relocate jobs including manufacturing and professional positions to country with cheap pool of labour. This will trigger an economic assault on not only the working class and the middle class, the bulwark of a capitalist democracy that would be disguised by massive personal debt as income decline or remain stagnant and borrowing soared. Politics in the late stage of capitalism become subordinate to economics leading to political parties hallowed out of any real political content and objectively subservient to the dictates of corporations. When there is no new market and no new pools of labour available to take on more debt, capitalism in the end will turn on the so-called free market along with the tradition and values it claimed to defend. It would in it's final stage pillage the system and structure that made capitalism possible. It would resort as it causes widespread suffering to harsher forms of repression to maintain social control. It will attempt in it's last stand to extract profit by looting and pillaging the institutions contradicting it's stated nature.

This is what you are seeing in and from the US. US will move it's factories all over the world to seek cheap labour. In the 90s, they came to Malaysia. When the price of labour to begin to rocket, they move to China. Now, people talk about robot and automation. Soon, people will be out of jobs because it will be replaced by robots. Auto-taxi? Taxi driver eat shit loh. You know US debt is damn bloody high, right? Why they can sustain? Because the export the dollar, e.g. oil can only be traded with US dollar. So what happening now is the world is de-dollarizing with China spearheading making US in deep trouble. The corporates in US are the real controller of the democracy in US, not Biden. As for Palestine, you know US is the veto power that block the UNSC intervention, right? At the same time they sell more arms to Israel? The political stance for Israel-Palestine is shifting since 2014 because the influence of US is degrading and all those secrets and shit from under the carpet is coming out. Remember Julian Assange? US is no longer trustworthy. It's full of lies. Germany wanted the Nord Stream Pipeline and US sanction them. He ignores even his own ally. Don't waste time with the MSM (MainStream Media) like BBC. It's full of propagandas.

You just need to read a little bit and you'll understand the problem with capitalism and how US is degrading and declining. But this time the difference maybe that US will bring the whole world down together with it.

I DON'T have any suggestion for people holding ATAIMS. I just hope people are aware of what is happening in the world and know how SHIT US is! They will interfere in every single SOVEREIGN countries for their own interest!

This is a ridiculous world. Just one man (supported by the powerful) can do so much damage to an industry. In a way, we investors also become a 'forced labour investors' losing our bonus and our pants not to mention our hard earned savings just because of the man. Where is our manpower/labour minister by the way???? If this is the way things should happen then we are not a sovereign country as proclaimed. Our economy can be controlled by the whips and fancies of just one man.

Our labour/manpower minister should be doing the job in finding out was there really cases of 'forced labour' in our manufacturing industries. Don't we have SOPs on how labour must be treated in our country? Why let someone else to do the findings and smear the name of our industries and country. I think this is a serious issue and a sovereign matter that must be addressed appropriately.

@pang72 CNN, Fox, MSNBC, etc. (MSM) viewership has plunge about 75%. People already found out how they work. Remember our TV3, TV2, etc? Do you watch TV3? I bet you don't. Why? "Bias" and "Lies". They will get some people usually so-called "Expert" to do the talking. And usually, the MSM objective is just to 'send THEIR message across' to the public. That's what you are seeing in the MSM in US about Palestine-Israel matter. They will often twist words to suit their narrative such as "right-to-self-defend", "clash", "terrorism". Whenever the guest DOES NOT have a narrative that align with the MSM, the interviewer will start interrupting, 'reframing' questions, redirecting the guest, etc. to realign it with the MSM narrative. That's why you often see on comment section that people keep saying "Let the guest finish their sentence!"

Because all those independent or LESS BIAS media is EMERGING in US, people are flocking over and hence, those MSM viewership are now plummeting. People right now prefer channels that enable viewer participation or more objective, e.g. it allows listeners to ask questions and participate in the discussion.

You know The Edge, right? When a stock is going down, they'll use the analyst that say it'll go down. When the stock is rising, they'll use the analyst that say it worth more.

If you start Googling now some narrative on the MSM like CNN, BBC, SkyNews, you'll see the pattern on Israel-Palestine matter. And if you start going to LESS BIAS non-MSM media you'll see an alternative view. You will then be able to judge for yourself.
